These Terms and Conditions ("Terms") govern your access to and use of the Dalka Schools School Management Platform ("the Platform") provided by Dalka Tech Solutions LLC. By registering for, accessing, or using the Platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By using the Dalka Schools Platform, you confirm that you have the authority to enter into this agreement on behalf of your institution and that you agree to these Terms in full. If you do not agree, you must not use the Platform.

2. Platform Access & Use

Access to the Platform is granted on a subscription basis. Only registered and authorized users may access the Platform.
You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.
You agree to use the Platform only for lawful educational and administrative purposes.
You may not reverse engineer, copy, reproduce, or resell any part of the Platform.

3. Subscription & Payment

Access to premium features requires an active subscription. Subscription fees are billed as agreed at the time of purchase.
All fees are non-refundable unless otherwise specified in our Refund & Cancellation Policy.
We reserve the right to change subscription pricing with 30 days' prior notice.
Failure to pay subscription fees may result in suspension or termination of your access.

4. Data Ownership

You retain full ownership of all data you input into the Platform ("Your Data"). By using the Platform, you grant Dalka Tech Solutions LLC a limited license to host, process, and store Your Data solely for the purpose of providing the service.

Each school's data is maintained in an independent, dedicated database. We do not share, sell, or transfer your data to third parties without your explicit consent.

5. Acceptable Use

You agree not to use the Platform to:

Upload or transmit any unlawful, harmful, or offensive content;
Attempt to gain unauthorized access to any part of the Platform or other users' data;
Interfere with the Platform's functionality or servers;
Use the Platform for any commercial purpose other than managing your school(s).

6. Intellectual Property

All intellectual property in the Dalka Schools Platform, including software, trademarks, logos, and content, is owned by Dalka Tech Solutions LLC. Nothing in these Terms grants you ownership rights to the Platform itself.

7. Service Availability

We strive to maintain high Platform availability. However, we do not guarantee uninterrupted service and are not liable for downtime caused by maintenance, infrastructure issues, or events beyond our control. Scheduled maintenance will be communicated in advance where possible.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Dalka Tech Solutions LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of or inability to use the Platform. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

9. Termination

Either party may terminate the subscription with 30 days' written notice. We reserve the right to immediately suspend or terminate access for breach of these Terms, non-payment, or unlawful use.

10. Governing Law

These Terms are governed by applicable international commercial law. Disputes shall be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the jurisdiction agreed upon at the time of contract.

11. Amendments

We may update these Terms from time to time. Material changes will be communicated with at least 14 days' notice. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
